The Hidden Risk of Letting Employees Use ChatGPT Freely

The data problem
When an employee pastes a client contract into ChatGPT, several things happen:
- That data leaves your network. It’s now on OpenAI’s servers, subject to their data policies — not yours.
- You’ve potentially violated client confidentiality. Depending on your agreements, sharing client data with third-party AI tools may be a breach of contract.
- The employee has no idea this is a problem. They’re trying to be efficient. They’re using a tool that feels as harmless as Google.

What a reasonable AI policy looks like
You don’t need a 50-page document. You need clear answers to five questions:
- Which AI tools are approved for work use? Name them specifically.
- What types of data can be input into AI tools? Create a simple classification: public, internal, confidential, restricted.
- What’s off-limits? Client data, financial records, personally identifiable information, trade secrets — spell it out.
- Who’s responsible for enforcing this? Without ownership, policies are just suggestions.
- What happens when someone makes a mistake? Not punishment — process. How do you contain and remediate?
The cost of doing nothing
Every day without a clear AI usage policy is a day your business is accumulating invisible risk. It’s not a question of if something will go wrong — it’s a question of when, and whether you’ll know about it when it does.
The good news: this is fixable. A straightforward AI risk assessment can map your exposure in weeks, not months. And the policy that follows is usually simpler than people expect.
The hard part isn’t creating the policy. It’s admitting you need one.
